1. About These Terms

These Terms of Service ("Terms") govern your access to and use of the website at activeforanimals.com and the tools made available through it, including the Engagement Tracker, the Social Media Content Planner, the Government Consultation Tool, the Cage-Free Egg Verification Tool, and other tools listed on the site ("Services"). They are provided by Effective Activism, operating as effectiveactivism.com ("we", "us", "our"), a Danish-registered organisation with VAT ID DK36667621.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. The Service

We provide software tools designed to help animal advocacy organisations manage outreach, relationships, and communications. Access to authenticated areas of the Services requires registration and is available only to approved organisations and their authorised users.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time. Where possible we will give reasonable notice of material changes.

3. Accounts and Access

Where you register an account or are invited to access a workspace, you are responsible for keeping your credentials confidential and for all activity under your account. You must notify us promptly at [email protected] if you become aware of any unauthorised use.

Accounts are personal and may not be shared or transferred without our prior written consent.

4. Acceptable Use

You agree not to use the Services to:

• Send unsolicited or deceptive communications
• Process personal data without a lawful basis under applicable data protection law
• Attempt to gain unauthorised access to any part of the Services or to another organisation's data
• Introduce malicious code or interfere with the operation of the Services
• Use the Services in violation of any applicable law or regulation

We may suspend or terminate access if we reasonably believe these Terms have been breached.

5. Intellectual Property

All intellectual property rights in the Services, including the software, design, and content we produce, belong to Effective Activism or our licensors. Nothing in these Terms transfers ownership of those rights to you.

Content you create, import, or upload through the Services remains yours. You grant us the limited right to process and store that content as necessary to provide the Services.

6. Disclaimer and Limitation of Liability

The Services are provided "as is" and "as available". We make no warranty that the Services will be uninterrupted, error-free, or fit for any particular purpose beyond what is expressly described.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the Services, including loss of data or business interruption.

Nothing in these Terms excludes or limits liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded.

7. Privacy and Data

We process personal data in accordance with our Privacy Policy, which forms part of these Terms. Where your organisation connects third-party accounts (such as a Facebook Page or Instagram account) to the Services, you acknowledge that the provider's own terms and policies also apply.

8. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to registered users in advance where reasonably practicable. Continued use of the Services after the effective date of any changes constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of Denmark. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Denmark, without prejudice to any mandatory consumer protection rights you may hold under the laws of your own country.
